120. Any guarantee required under the Regulation respecting the regulatory scheme applying to activities on the basis of their environmental impact (chapter Q-2, r. 17.1) or this Regulation to carry on an activity related to the management of hazardous materials is intended to ensure, while the activity is carried on and upon cessation of the activity, the performance of the obligations incumbent on the operator under the Environment Quality Act (chapter Q-2), its regulations, an order or an authorization. Should the operator fail to do so, that guarantee is to be used to pay the expenses incurred by the Ministère du Développement durable, de l’Environnement et des Parcs under sections 113, 114, 114.1, 114.3, 115, 115.0.1 and 115.1 of that Act.

120. The required guarantee is intended to ensure, during the carrying on of the activity and during the cessation, the carrying out of the obligations to which the operator is held pursuant to the Environment Quality Act (chapter Q-2), the regulations, an order or a permit. In the case of failure of the operator, the guarantee shall be used for the payment of the expenses incurred by the Minister of Sustainable Development, Environment and Parks under sections 113, 114, 115 and 115.1 of that Act.
